The bizarre incident took place in Vienna when the man in question was sitting with his friends in a park. They were all approached by the police officers for a routine identity check.

While the checking was still going on, the man let out the intestinal gas. According to BBC, he rose from a park bench, looked at the officers and intentionally released a massive fart. Following this, the police officers charged him for public indecency and ‘proactively’ farting at them.

MAN ARGUES FARTING IS A FORM OF EXPRESSION

The Austrian man then challenged the matter of the fine in the court. He made an argument that flatulence was a biological process, and even if it were an intentional act, farting must be accepted as his fundamental right for freedom of expression.

The court has finally given him some relief, reportedly. The administrative court reduced the charge from 500 euro to 100 euro (Rs 9,000 approximately). The decision came after the court considered the man’s financial situation and no past criminal records.

The court also added that though farts and burps may cause social awkwardness, they have no communicative content. Even if farts were accepted as a form of communication, the wind would still be a “form of expression that transcends the boundaries of decency.”
